Terms of Service

Effective date: April 21, 2026

These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “rider,” or “customer”) and Bear Crest Livery (“Bear Crest,” “we,” “us,” or “our”) governing your access to and use of our website, reservation system, and chauffeured ground transportation services (together, the “Service”). By booking a ride, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract to book with Bear Crest. By booking, you represent that the information you provide is accurate and that you are authorized to use the payment method you submit. Minors may only be transported when accompanied by a consenting adult or pursuant to an arrangement confirmed in writing by Bear Crest in advance.

2. The Service

Bear Crest provides professional chauffeured ground transportation, including airport transfers, point-to-point rides, and hourly as-directed service. Service availability, vehicle assignment, and routing are subject to driver availability, weather, traffic, mechanical condition, and operational judgment. We reserve the right to substitute vehicles of equal or greater class at our discretion.

3. Reservations & Authorization Holds

When you submit a reservation, your card is authorized but not charged until Bear Crest confirms the booking. Confirmation is at our sole discretion and is not guaranteed solely by submission of a reservation request. Once confirmed, the authorization may be captured in accordance with our Cancellation Policy. Quoted fares include base fare and applicable tax; gratuity defaults to 15% and is adjustable at checkout. Additional charges described in these Terms may apply.

4. Pricing, Fees & Additional Charges

You agree to pay the total fare displayed at checkout plus any additional charges properly assessed under these Terms, including but not limited to:

You authorize Bear Crest to charge your payment method on file for any such additional charges after the ride.

5. Cancellations, No-Shows & Modifications

Cancellations and no-shows are governed by our Cancellation Policy, which is incorporated into these Terms by reference. Bear Crest may cancel or modify a reservation for safety, weather, mechanical, regulatory, or capacity reasons; where we cancel and you are not at fault, you will receive a full refund of any authorization or charge.

6. Rider Conduct & Right to Refuse Service

You agree to treat our drivers, vehicles, and property with respect. The following are strictly prohibited and may result in termination of the ride without refund, assessment of fees, and/or referral to law enforcement:

Bear Crest and its drivers reserve the right, in their sole discretion, to refuse service or terminate a ride in progress for any of the above reasons or any other conduct the driver reasonably believes to be unsafe or unlawful. In such cases, no refund will be issued.

7. Seatbelts, Child Restraints & Passenger Safety

All passengers must wear seatbelts at all times while the vehicle is in motion, as required by applicable law. You are responsible for providing and properly installing any child safety seats; Bear Crest does not guarantee availability of child restraints unless confirmed in writing in advance. You assume all risks associated with your failure to use appropriate restraints.

8. Lost & Found

Bear Crest is not responsible for personal property left in the vehicle. We will make reasonable efforts to locate and return items upon request. Recovered items are held for up to 30 days. A handling and delivery fee may apply.

9. Flight Delays, Traffic & Force Majeure

While we monitor flights where a flight number is provided, Bear Crest is not liable for missed connections or delays caused by air carriers, weather, traffic, road closures, acts of God, civil unrest, strikes, mechanical failure, government action, pandemics, or other events beyond our reasonable control.

10. Third-Party Services

The Service integrates with third-party providers including, without limitation, Stripe (payments), Supabase (data storage), and mapping/routing providers. Your use of the Service may also be subject to the terms and privacy policies of those providers. We are not responsible for the acts, omissions, or content of third parties.

11. Intellectual Property

All content on the Service, including the Bear Crest name, logos, text, graphics, and software, is the property of Bear Crest or its licensors and is protected by intellectual property laws. You may not copy, reproduce, reverse-engineer, or create derivative works without our prior written consent.

12. Electronic Communications & Messaging Consent

By providing your phone number and email, you consent to receive transactional communications from Bear Crest relating to your booking, including reservation confirmations, driver dispatch notifications, receipts, and service-related messages. Standard message and data rates may apply. You may opt out of non-essential communications at any time.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BEAR CREST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ARRIVE AT ANY SPECIFIC TIME.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEAR CREST, ITS OWNERS, EMPLOYEES, DRIVERS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST WAGES, MISSED FLIGHTS OR CONNECTIONS, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO BEAR CREST FOR THE SPECIFIC RIDE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, IN WHICH CASE THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

15. Indemnification

You agree to indemnify, defend, and hold harmless Bear Crest and its owners, employees, drivers, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any law; (c) your violation of any rights of another party; (d) damage you or your party cause to the vehicle or other property; and (e) the acts or omissions of any person you invite into the vehicle.

16. Governing Law & Venue

These Terms are governed by the laws of the State in which Bear Crest Livery is registered to do business, without regard to conflict-of-law principles. You and Bear Crest agree that any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts of competent jurisdiction located in that State, and you consent to personal jurisdiction and venue in those courts.

17. Dispute Resolution; Class-Action Waiver

Before filing any formal legal action, you agree to first contact Bear Crest in writing and allow a reasonable opportunity (not less than 30 days) to resolve the matter informally. To the fullest extent permitted by law, you and Bear Crest each waive the right to bring or participate in any class action, consolidated action, or representative proceeding against the other.

18. Severability & Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

19. Changes to the Terms

We may update these Terms from time to time. Material changes will be indicated by updating the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
